Quest IV Health Agrees to Stop
Making False Claims for Two Products

On April 19, 1999, Texas Attorney General John Cornyn today a $15,000 settlement with Quest IV Health Products, to end its false health claims. Quest IV agreed to stop making the unapproved drug claims for the products, refund consumers who purchased these products, and pay the State $15,000.00 in attorneys fees.

In the marketing and labeling of Restores+ and Caucasicum+, Quest IV represented that the product is effective in treating Attention Deficit Disorder (ADD), Attention Deficit Hyperactivity Disorder (ADHD), and specific symptoms related to these diseases. The company also markets Caucasicum+ as a treatment for alcoholism and heart disease. Neither drug is approved by the U.S. Food and Drug Administration for the treatment of any disease. In fact, in April 1998, the FDA had warned company president Tom Spinks that many claims being made for these products were illegal.

Under the terms of the settlement, the company is required to stop the sale and distribution of Restores+, Caucasicum+ for the treatment of ADD, ADHD, alcoholism, heart disease, cancer or any other disease. In addition, the company may not represent that Restores+ or Caucasicum+ is an effective cure or treatment of any disease unless the claims are approved by the U.S. Food and Drug Administration.

Quest IV agreed to refund the full purchase price to any consumer who requests a refund, within 90 days of April 19, 1999, and presents a proof of purchase of Restores+ or Caucasicum+ or returns the product. Requests for refunds should be sent to Quest IV Health Products, Inc. 2106 West Pioneer Parkway, Arlington, Texas 76013.

This case was handled by the Dallas Office of the Consumer Protection Division. The settlement was filed in the 162nd District Court in Dallas.

Dubious Claims Persist

Despite the settlement, many "independent distributors" concinued to make the above-mentioned claims on their Web sites. Quest IV Health's headquarters Web site did not, but its claims for Restore+ and Caucasium+ were still questionable:

Restores+ is one of the most effective brain nutrient/brain foods in existence. . . . Restores+ gives the brain what it needs, and absolutely must have, to keep you well balanced. It gives your body the nutrition it needs to manufacture the chemicals your brain constantly uses. The formula took over 63 years to perfect and has been used in over 700 hospitals and clinics.

Do you feel down in the dumps and don't know why? Do you feel like crying and don't know why? Do you have an explosive temper or constantly feel like you need to eat? These are all emotions the brain uses to speak to you. It is telling you what it is lacking and what it needs is the exact ingredients found in Restores+.

and

Caucasicum+ is hailed as one of the most powerful digestive system protectors in the world. . . . Our digestive system is the first line of defense against dangerous microbes that enter our bodies constantly. Keep your gastrointestinal tract healthy with Caucasicum+ and in return, your whole body will be healthier.
